General Terms and Conditions (GTC) for orders via NK Croatia Zürich

We would like to present to you our general terms and conditions which set the framework for processing your purchase from us. We facilitate the purchase of items through our dedicated platform.

Our offerings on our website www.nkcroatia.ch are intended exclusively for consumers who make purchases for personal use and not for purposes that can be considered commercial or professional. Should you have commercial inquiries or questions from the media, please direct them to us via email at info@nkcroatia.ch.

Our products are available for purchase exclusively on www.nkcroatia.ch and through our official social media channels.

1. CONCLUSION OF CONTRACT AND DELIVERY OF GOODS

1.1 By submitting an order, you confirm that your purchase is for personal use only.

1.2 Contracts through www.nkcroatia.ch are concluded solely in German. NK Croatia Zürich is your contracting party when you purchase items through our platform.

1.3 Upon clicking "buy now," "order with obligation to pay," or "pay now," you are placing a binding order for the items in your cart. You will receive an email confirming the receipt of your order shortly after submission. A binding contract comes into existence once you receive this order confirmation. In cases of prepayment, the goods will be shipped once full payment and any applicable shipping fees have been received. Please arrange for the payment immediately after receiving the order confirmation.

1.4 You agree to the assignment of the seller's claims for the payment of the purchase price to third parties.

1.5 We reserve the right not to fulfill the delivery of ordered goods if we have ordered the items correctly on our end but did not receive them in a correct or timely manner, through no fault of our own. We will inform you promptly of any such unavailability and refund any payments made immediately.

1.6 We do not carry the risk of having to procure ordered items (supply risk), particularly when items are only described by type and characteristics (generic goods). Our obligation is to deliver from our available stock and the stock ordered from our suppliers. We ship orders within Switzerland. Business days are defined as Monday through Friday, excluding public holidays.

1.7 Orders placed through automated systems such as bots, crawlers, spiders, or using scripted behaviors, as well as third-party services on your behalf, may be refused or canceled.

2. PRICES, SHIPPING COSTS AND EXPRESS SHIPPING

2.1 The prices at the time of the order as listed on the offer are valid. All prices are inclusive of the legally applicable value-added tax.

2.2 Standard shipping is provided at no additional cost.

2.3 Certain products that are bulky, heavy, or of high value may have different shipping costs, which will be outlined on the product detail page and during the ordering process.

2.4 Warning:

Our products are manufactured outside of Switzerland. If you purchase products valued over CHF 65, additional import costs may apply that you will have to pay. We recommend that you order products valued at less than CHF 65 per order.

 

3.PAYMENT

3.1 We primarily offer payment methods such as credit card and Apple Pay. With every order, we reserve the right to exclude certain payment methods and suggest alternative ones. The customer is responsible for any costs incurred during money transactions.

3.2 Credit card purchases will be charged to your account at the time of ordering.

3.3 For purchases on account, the amount is due on the day of delivery reception. A customer is in default if payment is not made within 30 days after the due date, and NK Croatia Zürich may charge late fees in addition to the invoice amount. The fees for subsequent reminders are specified herein.

3.4 You agree to receive invoices and reminders in either electronic or paper format.

4. GOVERNING LAW AND JURISDICTION

4.1 All legal transactions or relationships with us are governed by Swiss law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) and any other international conventions do not apply unless the protection provided by mandatory provisions of the state in which the consumer has their habitual residence would be withdrawn by this choice of law.

4.2 Jurisdiction for consumers is the place of residence in Switzerland. For business transactions with merchants, our business location is the jurisdiction for all disputes, with the provision that we may also sue at the customer's place of residence. The minimum age for purchasing from www.nkcroatia.ch is 18 years.
